Welcome to Prestige Vacays, LLC ("Prestige Vacays," "we," "our," or "us"). By accessing, browsing, using, or making a reservation through this website, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, please do not use this website or booking platform.

1. WEBSITE USE

This website and its contents are intended solely for lawful purposes related to researching, planning, and booking vacation accommodations managed by Prestige Vacays, LLC. You agree not to:

* Use the website for unlawful purposes;

* Interfere with website functionality or security;

* Attempt unauthorized access to systems or data;

* Copy, reproduce, distribute, or commercially exploit website content without written permission.

We reserve the right to restrict or terminate access to the website at any time for misuse or violation of these Terms.

2. INTELLECTUAL PROPERTY

All website content, including text, photographs, graphics, logos, branding, property descriptions, videos, design elements, and other materials are owned by or licensed to Prestige Vacays, LLC and are protected by applicable copyright, trademark, and intellectual property laws. No content may be copied, reproduced, modified, distributed, published, or used for commercial purposes without prior written consent.

3. PROPERTY INFORMATION & AVAILABILITY

Prestige Vacays makes reasonable efforts to ensure the accuracy of property descriptions, photographs, amenities, rates, availability calendars, and other information displayed on this website. Because our homes are individually owned and periodically updated, furnishings, décor, bedding configurations, views, amenities, and property features may change without notice. Minor differences between photographs and the Property at the time of occupancy do not constitute grounds for cancellation, refund, relocation, or compensation.

All rates, promotions, discounts, and availability are subject to change until a reservation is confirmed.

4. RESERVATIONS

Submission of a reservation request does not guarantee acceptance. Reservations are considered confirmed only after:

* Required payments have been successfully processed;

* Identity verification or screening requirements have been satisfied when applicable;

* Guest has accepted all applicable rental terms, policies, and agreements.

Prestige Vacays reserves the right to decline or cancel reservations that do not satisfy booking requirements or that present a risk to the Property, neighboring properties, owners, or community.

5. PAYMENT AUTHORIZATION

By submitting payment and confirming a reservation, Guest acknowledges and agrees to all charges associated with the reservation, including applicable taxes, fees, authorized damage charges, excessive cleaning charges, smoking remediation fees, unauthorized pet fees, fines resulting from Guest violations, and any other amounts authorized under the applicable Vacation Rental Agreement. Guest authorizes Prestige Vacays, LLC and its payment processors to charge the payment method provided for all amounts due under the reservation and associated agreements.

6. VACATION RENTAL AGREEMENT

All reservations are subject to the applicable Vacation Rental Agreement, House Rules, Cancellation Policy, Property Rules, and Reservation Terms provided during the booking process. In the event of a conflict between these Terms & Conditions and the Vacation Rental Agreement, the Vacation Rental Agreement shall control with respect to the reservation and occupancy of the Property.

7. EXTERIOR SECURITY DEVICES

Certain properties may utilize exterior security cameras, video doorbells, driveway cameras, wildlife monitoring cameras, parking area cameras, or other exterior monitoring devices for security, safety, property protection, and compliance purposes. No cameras are installed inside living areas, bedrooms, bathrooms, or other interior spaces intended for Guest privacy.

Guests acknowledge and consent to the presence of disclosed exterior monitoring devices where applicable.

8. THIRD-PARTY SERVICES

This website may contain links to third-party websites, payment processors, mapping services, social media platforms, travel resources, or other external services. Prestige Vacays is not responsible for the content, policies, availability, security, or practices of third-party websites or services.

9. INTERNET & TECHNOLOGY

This website, booking platform, internet connectivity, reservation systems, and communication systems are provided on an "as available" basis. We do not guarantee uninterrupted website access, booking functionality, internet connectivity, email delivery, text messaging, cellular service, streaming services, or technology-related amenities. Temporary interruptions or outages do not create liability or entitlement to compensation.

10. BROKERAGE DISCLOSURE

Prestige Vacays, LLC operates as a licensed New Mexico real estate brokerage and property management company. In accordance with New Mexico Real Estate Commission (NMREC) regulations, Prestige Vacays and its affiliated brokers owe fiduciary and agency duties to the Property Owner. Guests acknowledge that Prestige Vacays acts on behalf of the Property Owner in connection with the management and rental of each Property.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Prestige Vacays, LLC, Property Owners, affiliates, brokers, employees, contractors, and representatives shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:

* Use of this website;

* Reservation requests;

* Booking platform interruptions;

* Errors or omissions in website content;

* Third-party services;

* Technology interruptions;

* Circumstances beyond our reasonable control.

Nothing herein shall limit liability where such limitation is prohibited by applicable law.

12. INDEMNIFICATION

Users agree to indemnify, defend, and hold harmless Prestige Vacays, LLC, Property Owners, brokers, employees, contractors, affiliates, and representatives from any claims, liabilities, damages, losses, costs, or expenses arising from:

* Violation of these Terms;

* Misuse of the website;

* Reservation-related disputes;

* Unauthorized activity conducted through the user's account or reservation.

13. GOVERNING LAW

These Terms & Conditions shall be governed by and construed under the laws of the State of New Mexico, without regard to conflict of law principles. Any dispute arising from these Terms or use of this website shall be brought exclusively in a court of competent jurisdiction located in the State of New Mexico.

14. CHANGES TO THESE TERMS

Prestige Vacays reserves the right to modify these Terms & Conditions at any time. Updated versions become effective immediately upon posting to the website. Continued use of the website following any modification constitutes acceptance of the revised Terms.
